Too many employers have been bluffed into believing that an outside body controls how they train their staff. NOT TRUE. All employers have the right to source vocational training from where they see fit. They can even have IN-HOUSE vocational training and credentialing. Employers can accept or reject any credential. However, fair play demands that no credential issued by an ITO or RTO should be rejected without allowing the holder the opportunity to prove their skills. If a credential is rejected purely on the basis of which organisation issued it, THEN THE HOLDER MAY HAVE A CASE OF WORKPLACE DISCRIMINIATION, WORKPLACE STRESS OR BULLYING AND SHOULD REPORT THE REJECTING COMPANY TO - FAIR WORK AUSTRALIA OR MAKE A WORKCOVER CLAIM FOR STRESS FOR THE TIME THEY ARE NOT ALLOWED TO WORKFurther, the discriminating company may be Guilty of CARTEL BEHAVIOUR and/or THIRD LINE FORCING or other restrictive trade practices which are illegal in Australia under the Competition and Consumer Act 2010. Or, if the rejecting company is a Tier 1 Contractor they may be in breach of their National Safety accreditation by the Federal Safety Commissioner and a complaint for WORKPLACE STRESS may be lodged with the Commissioner.
